The Champaign County State’s Attorney has announced that the shooting of 15-year-old Kiwane Carrington was an accident and the police officer whose gun was responsible for the death, Officer Daniel Norbits, will not be charged.
According the State’s Attorney report, Norbits was confronted by Carrington during the incident, and both Norbits and Police Chief RT Finney engaged in a physical fight with Carrington and his friend, Jeshaun Manning-Carter. Norbits and Finney said they saw Carrington put his hands in and out of his pockets, and it was unclear whether he was armed.
“There is no evidence that in the course of this situation Norbits intentionally or knowingly fired his weapon at Carrington,” according to the report. “Rather, the evidence supports the conclusion that he fired his weapon unintentionally, in the course of trying to subdue Carrington, who was not complying with his lawful instructions.”
The report states that the incident’s short time frame, the small area within which the event occured and “numerous unknown safety issues facing the officers when confronted with two uncooperative suspects” as observations supporting the incident’s classification as an accident.
The incident occurred Oct. 9 when police were called to the scene of a suspected burglary at 906 W. Vine St.
